Early Neutral Evaluation

Early Neutral Evalution (ENE) is a consensual process (like mediation) which allows parties in dispute to seek an independent, non-binding decision in their dispute.   The neutral evaluator's decision can help facilitate settlement between the parties or help dispose of specific issues.

Any dispute may be suitable for ENE.  But because the process is private, ENE may be particularly appropriate where the parties wish to maintain their business or private relationships.

In high value claims, the parties may prefer to appoint an ENE panel of three neutrals to give a joint decision about the issues in dispute.

Where appropriate, Oxford Mediation mediators are available to act as neutrals in ENE.  Some of our mediators have acted as neutrals in the resolution of very high value commercial disputes.
